Court restrains Kwara PDP chairman, exco from parading


A federal high court sitting in Ilorin, Kwara State, has restrained the state chairman of the Peoples Democratic Party (PDP), Akogun Iyiola Oyedepo, from parading himself until the determination of suit before it.

The court also restrained Abdulateef Alakawa Gidado, Alhaja Fatimoh Gegele Mogaji, Rasak Alabi, Mahmad Haliru Dantosho and Gabriel Olatunji from parading themselves as state executive committee members of the state chapter of the party pending determination of the motion on notice for interlocutory injunction filed before the court.

It is recalled that a factional chairman of the party, Prince Sunday Fagbemi, and four others who are aggrieved contestants for various positions into the executive committee of the state chapter of the PDP during the state congress of the party on November 13, 2017, had approached the court seeking an order of interim injunction.

The order, which was granted by Justice EB Mohammed, on Tuesday, July 17, 2018 al,so restrained any other person(s) either by themselves, servants, agents, staff or privies of Oyedepo and five other members of his executive from acting as the state executive committee of the party in the state.

“Upon a motion exparte and supporting affidavit dated and filed July 16, 2018. Upon a careful examination of 15 paragraphs affidavit of urgency and 33 paragraphs affidavit in support of the motion exparte for interim injunction respectively deposed to by Lateef Adebayo Oloyin, the third claimant herein.

“After listening to S. Imam learned counsel to the claimants/applicants and consideration of affidavit evidence in support and the written address of counsel.

“An order of interim injunction is hereby granted the claimants/applicants restraining the 1st defendant from reorganising, dealing and/or relating with the 2nd-7th defendants or any other person or either by themselves, servants, agents, staff and/or privies as the executive committee members of the Kwara State chapter of the Peoples Democratic Party PDP pending the determination of the motion on notice for interlocutory injunction already filed in this suit.

The claimant/applicants are further granted an order of interim injunction restraining the 2nd -7th seven defendants or any other person either by themselves, servants, agents, staff and/or privies from parading, acting and/ or working as the state executive committee of the People Democratic Party, PDP Kwara state chapter pending the determination of the motion on notice for interlocutory injunction already filed in this suit.

Given at Ilorin under the seal of the court and hand of the presiding judge on July 17, 2018. This case is hereby adjourned to July 30, 2018, for the hearing of the motion on notice.
