Ojo, 51, an electrician and resident of Onala
Street, Ado-Ekiti, had told the court that his wife had formed the habit of
always disturbing him on phone, leading to frequent quarrels.
He said that the woman was a good woman at first,
but suddenly changed.
The father of one, said that he rented an
apartment for her outside to avoid trouble between Funmilayo and his other
wife. “There was a day a customer called and my wife suddenly picked the call
and accused the caller of snatching her husband,” he said. He further
claimed that Funmilayo always called his other wife on phone and would rain
curses on her and the children.
He prayed the court to dissolve the marriage to
make for peace in his house.
But Funmilayo, 35, in her defence, denied ever
cursing her husband’s wife or the children. She said that when they met
each other, he told her to rent an apartment which he did and he always came to
check her and her child. She said his other wife had always called her on
phone and would hurl abusive words on her. The woman accused Ojo of
abandoning her and her child, saying that he had shirked his responsibility as
a husband and father.
Funmilayo admitted calling her husband’s caller a
husband snatcher on phone, but told the court that she begged her husband for
phone credit to apologise but was not given.
She did not object to the husband’s desire for
divorce, but urged the court to award the custody of her seven-year-old child, Joseph,
to her because of her husband’s failing health condition.
The President of the court, Olayinka
Akomolede, in her judgment, observed that the marriage had broken
down irretrievably and consequently dissolved it.
Akomolede awarded custody of the child to the
wife, while the husband should be responsible for his education at all
levels. She also ordered that the husband pay N5,000 monthly allowance for
the feeding of the child.
