Lagos appeals ruling forbidding govt from punishing unregistered lotto operators


The Lagos State Government has appealed the judgment of the Federal High Court in Lagos, which in April this year restrained it from shutting down lotto companies who failed to obtain its licence.

Justice Mohammed Idris gave the judgment in favour of Western Lotto Nigeria Ltd and Wesco Pools & Lottery Ltd, who prayed the court to determine “whether in view of subsisting and binding judgments of the court, the defendants can close down the plaintiffs’ businesses for not obtaining licences from the states despite having been granted nationwide permits/licences by the National Lottery Regulatory Commission.”

In his judgment, Justice Idris declared that “having been granted national permits, the defendants cannot close down such business for reason that the plaintiffs have not obtained additional license to operate their lottery business.”

He restrained “the defendants or their agents from disrupting the plaintiffs’ business in any manner having been given national licences pursuant to the National Lottery Act of 2005.”

Displeased, however, with the judgment, the Lagos State Government said in a statement by the Public Affairs Officer, Lagos State Lotteries Board, Quadri Adeleke, said it had proceeded on appeal.

Adeleke said, “The Lagos State Lotteries Board is dissatisfied with the judgment and has appealed the said judgment.

“The Lagos State Lotteries Board is an agency of government set up to promote, protect and regulate lotteries and other gaming activities in Lagos State.”

While encouraging all lotto operators who had obtained licence from the said to carry on with their business, Adeleke urged “recalcitrant operators to abide with the gaming laws that operate in Lagos State.”
